The purchase of the products offered on this website presupposes, in all cases, acceptance of these terms and conditions in the version published by SD EIBAR at the time of purchase. Therefore, it is advisable for the customer to read these General Conditions before making a purchase. These purchase conditions apply to all sales made through this website. By placing an order, you guarantee that you are over 18 years of age and have the legal capacity to enter into binding contracts.

We may update these terms and conditions, as well as the Legal Notice and our Privacy Policy. at any time. You can view, download, and print these terms and conditions of purchase .

 

TERMS AND CONDITIONS

The languages ​​in which the User may formalize the contract are: Spanish, Basque and English.

Communication of data and information for the development of the service

You do not need to be registered to browse the store or add products to your cart, but you DO need to be registered to purchase.

The user must provide SD EIBAR with all necessary data for the provision of the services on this website and for the purposes indicated above, as well as in the Legal Notice and our Privacy Policy for this website. The data and information provided must always be valid and up-to-date, and it is essential that you provide all the information we classify as mandatory, as failure to do so will prevent us from providing the services. We will not be liable under any circumstances for any delays or failures in delivery resulting from errors or omissions in this data.

 

Availability

The products presented in the online store are valid within the limits of availability indicated on the product sheet itself.

We may cancel an order due to lack of availability, regardless of the information published on the website at the time the order was placed and the customer has received confirmation by email. However, we will notify the buyer as soon as possible, offering the option of replacing the product with a similarly priced product or canceling the purchase in part or in full. In the event of partial or total cancellation of the order for this reason, we will refund the amount paid within a maximum period of 14 calendar days.

 

Purchase procedure

The characteristics of the products offered through this website can be found in the description sheet that presents each product. You can browse the website until you find the desired product. Once located, clicking on it will take you to all the purchase information: price, taxes, shipping costs, etc. From there, you can add the product to your cart.

We inform users that the product images published are illustrative and in some cases may have become outdated and may not exactly correspond, in some details, to the product actually offered or available at the time of purchase. In case of any discrepancies, our sales team is available to inform you of the available alternative.

Contracts are subject to Spanish law; therefore, contracts shall be deemed to have been concluded at the registered office of SD EIBAR, located at Paseo de IPURUA KALEA, 2 – 20600 EIBAR (GIPUZKOA).

 

Order selection

You must select the product once you decide to purchase it. The price appears with VAT included (see example in the screenshot below).

Discount coupons

If you have discount coupons, you must enter them in the "Enter your coupon code?" box during the checkout process, and the agreed-upon discount will be applied to the final price.

2.6. Order confirmation

Placing an order always entails the obligation to pay for it. Payment must be made in full in advance using the methods indicated in section 2.7 below. After selecting the product and deciding to purchase it (see example in the screenshot below), the customer will receive confirmation of the purchased products and their value (see example in the screenshot below).

Upon confirmation, the order is final and will be automatically registered, and SD EIBAR will proceed with its shipment and/or delivery to the indicated address. The automatic registration of the order placed is considered proof of its nature, content, and date. Confirmation of the order by the customer implies acceptance of the prices, product description, and other conditions set forth either in the data collection forms that the user must complete or in this document.

After confirming an online order, an email will be sent to the address you provided confirming the order and the successful completion of the ordering process. This email will include information regarding the contract: amount, product purchased, and contact information; as well as an order reference number. This reference number uniquely identifies your contract on the website and is how SD EIBAR staff can identify your contract should you have any questions.

The purchase receipt (or invoice, if the purchase amount exceeds €400, or upon express request) is automatically generated and sent by email to the email address provided. If the invoice is issued to a third party at the Customer's request, both parties will be jointly and severally liable for payment. The user has the right to receive a paper invoice at no additional cost; to do so, they must provide their Tax Identification Number (NIF), first and last name or company name, and billing address. Additionally, the customer expressly consents to the electronic invoice, which they may revoke at any time by sending an email to the contact address indicated in the preliminary provisions section of these terms and conditions.

 

Price, currency and taxes .

The applicable prices are those indicated on the website on the date the order is placed. The prices listed for each product are shown in euros (€) and include VAT at the time of purchase. Shipping costs are included for orders of €60 or more. For orders under this amount, the shipping cost appears in the purchase description. Once the products are added to the cart, a breakdown of their tax base and applicable VAT will appear, as well as the total amount to avoid any potential price confusion. Shipping costs are included in prices of €60 or more for the Spanish mainland.

The applicable VAT rate will be the legally applicable rate at any given time. SD EIBAR reserves the right to make any changes it deems appropriate at any time and without prior notice, and may update prices and services based on new developments.

Once the products are added to the cart, a breakdown of their tax base, including taxes, shipping costs (also included), and the total amount will appear to avoid any potential price confusion.

SD EIBAR assumes no liability for any typographical or arithmetic errors that may appear in the prices indicated on its pages. However, it undertakes to correct them as soon as possible, to notify customers who have purchased the product of the error and the new price, and to offer them, in the event that they do not accept the new price, the right to cancel, provided that the purchased products have not yet been delivered. In the event of partial or total cancellation of the order for this reason, SD EIBAR undertakes to fully refund the amount paid within a maximum period of 14 calendar days and always using the same payment method used for payment.

Product offers will be displayed in the "PROMOTIONS" section or indicated on the product page. Unless otherwise indicated, they will be valid once added to the shopping cart.

Any products that appear to be priced at €0.00 will be removed from any order due to computer errors and incorrect prices. In these cases, we are committed to correcting these errors as quickly as possible.

Discount coupons have a specific validity period and terms and conditions for use. Check the specifications for each coupon before using it.

 

Payment methods and conditions

The accepted payment methods are listed below. Payment by Credit Card: We accept Visa, Mastercard, and American Express credit cards, as well as PayPal. All online credit card payments are made through Caixabank's secure REDSYS payment gateway. When confirming your order, the buyer must provide their bank card number, followed by the type of card (among those accepted), its expiration date, and the three-digit cryptogram on the back of the card.

REDSYS uses the HTTPS (SSL) protocol to establish a secure communication channel between the server and the user for sending their personal data, preventing third parties from accessing the information sent. The charge will be made in real time through this payment gateway. If the charge cannot be ultimately processed (for any reason), the order will be automatically canceled. Credit cards are subject to verification and authorization by the issuing entity, but if the entity does not authorize the payment, we will not be able to formalize any contract with you. Please note: Credit card fraud is a crime, and SD EIBAR will take appropriate legal action against anyone who makes a fraudulent transaction on our website.

 

Shipping/Delivery

SD EIBAR delivers products in Spain, the Balearic Islands, and the Canary Islands. Shipping costs are included in the price displayed next to each product and/or service, provided that it is equal to or greater than €75. For deliveries abroad, an additional shipping cost will be added to the product price. This shipping cost will be automatically added to the price when including a shipping address outside of Spain.

In case of force majeure (situation that prevents the delivery of the order for reasons beyond SD EIBAR's control: strikes, war, flood or other natural disaster, lack or impossibility of supplying materials, etc.) the customer will be notified with the proposal of a new delivery date without any liability arising for SD EIBAR.

The contracted transport conditions are for daytime deliveries, Monday through Friday, with no prior notice or possibility of agreeing on delivery at a specific time, and with two delivery attempts. If the recipient is not at home when the first attempt is made, the The carrier will contact the customer using the methods provided (phone call and/or text message) to arrange a second, final delivery, which will be free of charge. If this second, final delivery is not made for any reason, the customer may incur an additional cost for the third delivery or may have to collect the package at the shipping company's branch indicated by the carrier. The time during which the order can be collected at the branch indicated by the carrier, if delivery has not been possible at the indicated address, will depend on each agency. SD EIBAR has no control over the storage periods for undelivered orders at shipping agencies and, consequently, cannot assume any responsibility if the order is not collected within that time and is ultimately returned to its origin. In this case, SD EIBAR will be required to charge the corresponding return costs to the customer, as well as the redelivery costs if the order is requested to be sent again.

To avoid delivery issues, it is essential to correctly complete the corresponding form, including the contact telephone number and email address.

 

Shipping and delivery time

Delivery will take place within 2-3 business days . This timeframe is estimated and not guaranteed, except for the maximum of 30 calendar days established by law. It may vary slightly due to transport disruptions for a variety of reasons: unforeseen local holidays or exceptional periods such as the Christmas holidays, or situations of high demand such as the launch of special promotions, or other reasons. We will keep the buyer informed of any exceptional delays. If SD EIBAR fails to fulfill its delivery obligation within this timeframe, the consumer must provide a reliable notice to comply within an additional period appropriate to the circumstances. If SD EIBAR fails to deliver the product within this additional period, the consumer shall have the right to terminate the contract.

Products will not be delivered to PO boxes or any address that is not correctly specified.

When the merchandise arrives at the transport agency (DHL), the latter will send an email to the buyer informing them of the delivery date and four possible delivery options, in case they cannot receive it at the address provided in the order:

1. Delay delivery by one week

2. Make the delivery to a neighbor's home.

3. Make the delivery to the Service Point closest to your home (the available ones are indicated in the email itself)

4. Refuse delivery

If the recipient is not at home on the first attempt, a second attempt will be made. If the second attempt fails to deliver to the address provided by the customer, the merchandise will be available for pickup at a Service Point for 10 days. If the merchandise is not picked up within this timeframe, it will be returned to the branch.

SD EIBAR has no control over the storage periods for undelivered orders with shipping agencies and, consequently, cannot assume any liability if the order is not collected within that time and is ultimately returned to its origin. In this case, SD EIBAR will be required to charge the customer the corresponding return shipping costs, as well as the redelivery costs if the order is to be sent again.

Once the purchased product has been delivered, it will become your property, and therefore, any damage, loss, etc. that may arise will be your responsibility.

 

Claims and returns

Complaints: Please retain proof of purchase; it is required for any complaint. We will respond to complaints received as quickly as possible and, in any case, within one month of the complaint being submitted. SD EIBAR shall be solely liable for any failure to provide the service, in the timeframe and manner stipulated in this contract. SD EIBAR shall not be liable under any circumstances for any other damages of any kind or nature that may arise from non-compliance or delays due to force majeure or circumstances beyond its control.

If for any reason you are not satisfied with your order, you have 14 calendar days from the date of delivery to return it or cancel your purchase.

For products purchased under the "outlet" promotion, the return period is also set at 14 calendar days.

Returns or withdrawals of screen-printed or personalized products will not be accepted.

How to make a return or exchange:

1.       Return the product directly to our physical store, located at Calle Ipurua kalea 2 bajo, 20600 Eibar (Gipuzkoa), Spain, presenting the invoice for your order.

2.      Return the product by mail to the following address: Ipurua kalea 2 bajo, 20600 Eibar (Gipuzkoa), Spain. The return costs will be at your expense, unless the product has a defect or is not the one requested.

In the event that the product has a defect or is incorrect, this must be confirmed when requesting its return via the following email address : store@sdeibar.com .

The product must be returned in perfect condition, unused, and in its original packaging, including the delivery note, warranty, labels, and instructions for use. It is very important that you return the product(s) properly packaged. If the product(s) are damaged due to improper packaging, we will not accept the return. No withdrawal or return will be permitted when there are indications that the products have been tampered with or exposed to inappropriate conditions.

Once we receive the merchandise in our warehouses and verify that all the above conditions are met, SD EIBAR will accept the return of the product and proceed to refund its amount according to the payment method used, and, if applicable, to send the new product: If you made the payment by credit card or PayPal, the amount will be credited to the same credit card or PayPal account.

Note: You will receive your refund within 14 days of receiving the exchanged or returned product at our warehouse. Please note that if you paid by credit card, your bank may not show the refund amount in your balance until the following month.

Returns with postage due and claims for invoices for shipments arranged by the customer are not accepted. For more information, please contact store@sdeibar.com.

 

Withdrawal

As stated in section c) of Art. 103 of the General Law for the Defense of Consumers and Users , the right of withdrawal will NOT apply with respect to:

-     The supply of goods made according to the specifications of the consumer and user or clearly personalized

-     The supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery

Jurisdiction and competence

If the User is NOT a consumer, in the event of a conflict or dispute regarding the interpretation of these terms and conditions or any matter related to the services of this Website, the applicable jurisdiction and regulations will be Spanish, and the competent courts (with express waiver of any other jurisdiction that may apply) will be those of Eibar. If the User is a consumer, the competent courts will be those of their domicile or those of the place where the obligation is fulfilled.

 

Legal guarantee

If you purchase a product as a consumer and user, you have the right to corrective measures, free of charge, in the event of non-conformity in the goods. We offer guarantees on the products we sell through this website, in accordance with the legally established terms for each type of product. We are therefore responsible for any non-conformity that becomes apparent within three years of delivery.

 

It is understood that the products comply with the contract provided that (i) they fit the description made by us and possess the qualities that we have presented on this website, (ii) they are suitable for the uses to which products of the same type are ordinarily intended and (iii) they present the quality and performance usual for a product of the same type that can reasonably be expected. In this sense, if any of the products do not comply with the contract, you must inform us by following the procedure detailed in the previous section and through any of the means of communication provided for this purpose.

 

Defects or damage due to improper use or handling of the product, or wear and tear resulting from normal wear, are not covered by this warranty. Losses in product functionality due to design limitations are also excluded from this warranty.

 

If upon receiving your order, before using the product, you find any defect or fault with the item, please contact us at store@sdeibar.com . We will request a photo or video of the defect and will collect the product. Once we receive it, we will exchange or replace it using the methods indicated above, or if that is not possible, we will refund your money.
